NOTE: This is a transcript of Adam Maxwell's Last Will and Testament; written and signed in 1820. A later document, also transcribed here, is Armstrong County Estate #417, in which Adam Maxwell is said to have died intestate.

Last Will and Testament of Adam Maxwell
Signed 16 October 1820



In the name of God Amen: I Adam Maxwell of the township of Buffaloe, Armstrong County, a [???] of the State of Pennsylvania, being of sound disposing mind and memory, do make and ordain this to be my last will and testament.

1st
I want all my just debts to be paid, and for this propose. I do hereby authorize and empower my Executors to sell and convey by a good & sufficient Deed, Eighty or one hundred acres of land (if necessary) off the south east end of the tract on which I now live, situate in Buffaloe township.

2nd
I give and bequeath to my beloved wife Elisabeth the one third of all my personal estate in lieu of her dower to be at her sole use and disposal.

3rd
I give and bequeath to my sons James, William, and David each one horse of equal value and as to the residue of my personal estate I give and bequeath to my sons James, William, David, Adam, and John to be equally divided between them.

4th
The residue of my tract of land or real estate I devise as follows: I give and devise the one third part of my tract of land on which I live to my son James, his heirs or assigns for ever. The remaining two thirds I give and devise to my sons William, David, Adam, and John to [???] to them and their heirs forever. The said bequest of land to be divided and laid off in such manner as my sons may think proper.

5th
It is my will and direction that the following bequests be paid out of my estate by my sons James, William, David, Adam, and John via James to pay one third and the others the remaining two thirds.

6th
I give and bequeath to my beloved daughter Elisabeth one hundred dollars and one horse and saddle to be paid whenever she leaves the family and it is my request that she shall have the liberty of living in the dwelling house with the family to provide and work for herself so long as she remains single.

Item -
I give and bequeath to my beloved daughter Sarah wife of Benjamin White one saddle and a dress to be delivered three years from this date.

Item -
I give and bequeath to my beloved Daughter Margaret wife of William White one saddle and a dress to be delivered three years after this date.

Item -
I give and bequeath to my grandson Adam of William White one small horse and saddle to be delivered to him as soon as he arrives to the age of twenty one years.

Item -
If the sale of that part of my land which I have directed to be sold by my executors there should remain any surplus over and above the payment of my debts I then give and bequeath the sum to James, William, David, John and Adam.

Item
If my executors cannot sell the said piece of land to advantage, I then direct my personal property to be sold for the purpose of paying my debts, in which case I then give and bequeath the said piece of land to my sons James, William, David, Adam and John to be equally divided between them.

I do hereby constitute and appoint my wife Elisabeth my executrix and my sons James, William, and David executors of this my last will and testament: In testimony whereof have [???] set my hand & seal this 16th of Oct AD 1820.
